About these terms

These terms apply to anyone browsing nativosjalapao.com.br. By using the site, you agree to the rules below. If you do not agree, we recommend that you do not use it.

The site is operated by Nativos Jalapão, CNPJ 37.395.960/0001-08, Cadastur 37.395.960/0001-08, with registered office at Av. NS-10, Quadra 806 Sul, Conj. PAC, Lote 24-A, Sala 101 — Palmas/TO, CEP 77023-056.

The site content

Information about itineraries, attractions, accommodation and services is for information purposes only and may change without prior notice, mainly because of weather, road conditions, availability or safety.

• The photos are illustrative and show real expeditions, but do not guarantee the same landscape, weather or wildlife conditions.
• The published itineraries are not a commercial offer: prices, dates and conditions are confirmed in the quote.
• The order of the attractions in each itinerary may be changed by the team during the operation.

Intellectual property

The Nativos Jalapão brand, the logo, the texts, the photos, the videos, the illustrations and the layout of this site belong to Nativos or have been licensed for its use.

• Copying, reproducing or publishing this material without written authorization is prohibited.
• Partner agencies and tour operators may use the sales material provided by Nativos, within the conditions of the partnership.
• Photos sent in by travelers and influencers are published with permission and keep the credits indicated.

Permitted use

You can browse, look up information and contact us. You may not:

• Use the site for unlawful purposes or in ways that violate third-party rights.
• Try to access restricted areas, systems or other users' data.
• Collect data from the site by automated means without authorization.
• Send, through the forms, offensive or false content, or third-party content without consent.

External links and channels

The site links to external channels such as WhatsApp, Instagram and Tripadvisor. These services have their own rules and Nativos is not answerable for their content or their privacy practices.

Booking a trip

An expedition is not purchased through this site: it is booked through a proposal sent by our team or by a partner agency. What governs the parties is the travel services agreement signed at booking — the summary below is here so you know what to expect before you get there.

What is included and what is not follows the itinerary sheet and the proposal. In sales made by agencies and tour operators, the terms of the contract signed with them also apply.

Payment

• PIX or cash: 10% off the price of the expedition.
• Credit card: up to 6 interest-free installments.
• Credit card: up to 18 installments with interest, according to the terms and rates of the card issuer.

Withdrawal and cancellation by the traveler

Under article 49 of the Código de Defesa do Consumidor (Brazilian Consumer Protection Code), you may withdraw within 7 days from the signing of the contract and receive back everything you paid, provided that performance of the services has not yet begun.

After that period, cancellation is subject to a cancellation fee, calculated on the total contracted amount and according to how far in advance of the start of the trip it is requested. The cancellation fee covers operating costs, advance bookings and amounts already committed to suppliers.

• 20% — cancellation more than 60 days in advance.
• 30% — cancellation between 60 and 30 days before the trip.
• 50% — cancellation between 30 and 15 days before the trip.
• 70% — cancellation less than 15 days before the trip.

The amount of the cancellation fee may be withheld from what has already been paid, or charged, if payment has not yet been made. Refunds due are issued within 30 business days from the formalization of the cancellation, less the deductions above and any amounts already paid to suppliers that cannot be recovered.

You may name another person to take your place, provided you request it with reasonable notice, it is operationally feasible and no supplier involved prevents the change. An administrative fee may apply.

Last-minute withdrawal and failure to show up (no-show)

There is no return, refund or credit of any amounts in the event of withdrawal on the day of departure, voluntary abandonment of the itinerary, interruption of the expedition on your initiative, or failure to show up at the agreed place, date and time. In these cases, the amounts still outstanding under the contract remain due.

Rescheduling

• You are entitled to one rescheduling, with no need to give a reason, requested in writing at least 7 days before the original date.
• Rescheduling depends on availability on the new date and on payment of a fee of R$ 200,00 per person, upon confirmation.
• The new date is only valid after Nativos confirms it in writing, the fee is paid and, where applicable, any difference in the price of the package, of fares or of bookings is settled.
• Requests made outside the 7-day period, or a second rescheduling, depend on agreement between the parties and on a written contract amendment.
• If rescheduling is not possible, the contract is terminated with the cancellation fees described above.

Minimum group size

Some itineraries state a minimum number of participants — when that appears on the itinerary page, the departure is only confirmed once that number is reached. Until then your booking is on record, but the date is not yet guaranteed.

Cancellation by Nativos

Nativos may terminate the contract, without prior notice or compensation, in the event of:

• payment more than 30 days overdue;
• breach of the contract, or inappropriate, aggressive, offensive or unlawful conduct that puts at risk the safety of the expedition, of third parties, of the team or of the property involved;
• bankruptcy, judicial or out-of-court reorganization;
• unforeseeable events or force majeure.

Termination caused by a breach by the traveler does not give rise to any right to damages, full refund or compensation of any kind.

The nature of the expeditions

The expeditions take place in a natural environment, with long stretches on dirt roads and swims in rivers, fervedouros — springs where the water pushes you up and you float without swimming — and waterfalls. By travelling with Nativos, the traveler agrees to:

• Follow the safety instructions given by the guides.
• Report, before the trip, any health conditions that may affect participation in the activities.
• Respect the communities, the attractions and the visiting rules of each place.

Itineraries may be changed because of rain, river flooding, closure of attractions or any situation involving safety, without this constituting a breach of what was agreed.

Use of image and voice

During the expeditions, guides and travelers take photos and videos. By booking a trip, you authorize Nativos to use your image and your voice captured during the provision of the services — expeditions, itineraries, events and related activities. This authorization is part of the travel services agreement you sign at booking, is granted free of charge and has no end date.

The material may be used in:

• social media, such as Instagram, Facebook, TikTok, YouTube and LinkedIn;
• the Nativos website and blog;
• printed materials, such as flyers, catalogs, banners, magazines and newspapers;
• advertising campaigns and promotional or corporate videos;
• television, radio and digital broadcast media.

There is no limit of territory or of number of showings: the material may be used in Brazil or abroad, including after the contract ends. The authorization is free of charge, with no talent fee, share of sales or compensation.

Nativos holds the rights to the photos and videos it produces and may edit, crop or combine them as needed. In return, it undertakes to use them ethically, respecting your honor and your reputation — never in a degrading or unlawful context.

If there are minors under 18 in the group, the person booking signs this authorization on their behalf as well, as their legal guardian.

Anyone who prefers not to appear can tell the team at any time and ask for the material to be removed.

Limitation of liability

We work to keep the site online and the information correct, but we do not guarantee uninterrupted operation or the absence of errors. Nativos is not answerable for losses arising from the site being unavailable, from failures in the user's connection or from third-party content accessed from here.

Governing law and jurisdiction

These terms are governed by Brazilian law. The courts of the judicial district of Palmas – TO are elected to settle any disputes, without prejudice to the right of the consumer to choose the courts of their own domicile.
